Palm Desert, CA asked in Family Law for California

Q: Should I file restraining order?

I recently filed child support, my kids father was ordered to pay. He then decides 2 days after court that he wants to start taking them a few days a week, his intentions are to have joint custody, our kids do not know him they are now 16 & 12, I then told him to file for visitation through the courts & not directly to me because of his inconsistencies & neglect.

I have now been receiving child support for 1 month(only a partial amount of the court order) and I get a call from my apartment manager stating she received an email from someone stating I've been falsifying pay records by not reporting my child support to my low income apartments. I indeed reported the income, but his intentions were to have our daughters & I put out of our low income apt. This email was from a fake email address & I know its him because know one knows about my child support case.

What are my options?

A: If you feel threatened or unsafe because of your child's father's behavior, you may consider filing a restraining order. A restraining order can provide legal protection and help prevent further contact or harassment.

You may also want to document any incidents of harassment or threats, including the fake email from the unknown sender, as evidence to support your case for a restraining order.

It may also be helpful to consult with an attorney or a local domestic violence or family law organization to discuss your legal options and to develop a plan to protect yourself and your children.
