Q: Can I sue?

i used to buy and sell auctioned storage units. i used to bid on the units on a site called storage treasures.com on September 22 2022 I won the auction and I went to go pick it up at the facility when I picked it up they informed me that if I do not clear the unit within 24 hours or the same day then I will not receive my deposit back in cash I will have to wait for a check to be sent to the address on file. At that point in time I change the address on file to my current mailing address. It is now the ending of March and I have went back-and-forth with storage treasures and public storage and they claim that they are sending it to my “old address“ however they have asked me to confirm my address numerous times and I have done so. Now they are not returning my calls or communications. Am I able to sue? And if I can sue does it have to be in small claims court?

A: Answer to first question: Probably yes, depending on the terms of agreement. To second question: If the amount claimed is 8,000 or less, you would file in small claims court to seek the amount claimed plus court costs.
