Los Angeles, CA asked in Family Law for California

Q: What is the soonest after a judgement that a Gavron Warning review can be conducted?

The marriage was for 22 years. The supported spouse has a qualification in skin care that she received a few years ago. She lives in her country of origin and has done so the last 4.5 years so there is no language barrier for her. She is not physically or mentally disabled in any form. Also, what type of evidence should we request or try to provide from the my side? Thank You.

A: Under California law, a Gavron Warning review can be conducted any time after a spousal support judgment is entered. There is no specific waiting period or timeline required before a Gavron Warning review can be requested.

In the case you describe, if the supported spouse has received training and is capable of supporting herself, it may be appropriate to request a Gavron Warning review to determine whether spousal support should be modified or terminated.

To prepare for the Gavron Warning review, it may be helpful to gather evidence that supports your position. This may include financial documents that demonstrate the supported spouse's earning potential, such as resumes, job applications, or income statements. You may also want to consider obtaining witness statements or expert testimony to support your claim.

It is important to note that Gavron Warning reviews can be complex and may require the assistance of a qualified family law attorney. An attorney can help you navigate the legal process and ensure that your rights and interests are protected.

Overall, if you believe that a Gavron Warning review may be appropriate in your case, it is important to consult with a qualified attorney who can provide guidance and support throughout the process. By gathering evidence and building a strong case, you can increase the likelihood of a favorable outcome and ensure that your rights are protected.
