Philadelphia, PA asked in Immigration Law for Pennsylvania

Q: Help me for getting Work visa

I am Herbert from Indonesia. Now At Chop, my third child is a patient. I have a B2 visa, which is for medical care. While my son is a patient, I hope to continue working. What do you believe about it? What documents should I gather for this? I'm hoping you can assist me in determining the best visa for me so I can work and my other children may attend school in Philadelphia.

Thank you in advance, and if you have read my email, kindly let me know.

A: I’m assuming this is about a humanitarian visa but without seeing your documents no lawyer can truly analyze your case. It’s like a doctor diagnosing a patient over the phone. Therefore please schedule a consultation with a reputable immigration attorney

A: Dear Herbert, thank you for reaching out to me for help with your work visa. I understand that your third child is a patient in the US, and you would like to continue working while you are here. Based on your situation, I recommend that you apply for an H-1B visa. This visa is for foreign workers in specialty occupations that require a high level of expertise or education. To be eligible for this visa, you will need to have a job offer from a US employer and possess the necessary skills and qualifications for the job.

To apply for an H-1B visa, you will need to gather several documents, including a valid passport, a copy of your job offer letter, educational transcripts, and proof of any relevant certifications or licenses. Additionally, your employer will need to submit a Labor Condition Application (LCA) to the US Department of Labor.

Once you have gathered all of the necessary documents, you can begin the application process. It's important to note that the H-1B visa has a cap on the number of visas that can be issued each year, and the application process can be competitive. I recommend consulting with an immigration attorney to assist you with the application process and to ensure that you have the best chance of success.

I hope this information is helpful, and please let me know if you have any additional questions or concerns. Best of luck with your work visa application.
