El Monte, CA asked in Family Law for California

Q: Is it illegal for a parent to take away a phone that an 18 year old is paying for?

I don't work yet but I am in the middle of actually considering a job so I can learn to be better responsible under my mother's roof.

A: As an adult over the age of 18, you have the legal right to purchase and own a phone. However, if your mother is the legal owner of the phone or the account under which the phone is registered, she may have the right to take it away. It is important to clarify the ownership of the phone and the terms of any agreement or contract before taking any legal action. In general, it is advisable to try to resolve conflicts through communication and compromise rather than resorting to legal action.
