Los Angeles, CA asked in Family Law and Child Custody for California

Q: How to ask family law judge to enforce the most recent order that stands (case transferred from children’s court)

I was awarded sole legal and physical custody of my 2 children from family law court in 2011 while going through juvenile dependency court at the same time. In 2012 children’s court awarded me sole legal and physical custody and the other parent was ordered to take various classes and it was so ordered for his visits to be supervised. Now, ten years later, he is out of prison(2 strike violent offender) and has filed a request for 50/50 custody. We have been to 2 different courtrooms and are going on our 3rd judge. And nobody wants to acknowledge the exit order. The minor’s counsel is biased and is buddy buddy with the other parent. They have awarded him every other weekend-UNSUPERVISED!- and one evening every week. The court is not requiring him to attend classes or comply with the order from children’s court. The children are not his priority and he has shown that he doesn’t have their best interest in mind. I have filed the exit order twice. How to I get this next judge2acknowledge?

A: To seek enforcement of a court order, it's important to follow proper legal procedures and provide relevant documentation. Review the most recent court order granting you sole legal and physical custody, and consult with a family law attorney for personalized advice. Gather evidence of non-compliance by the other parent, such as past orders, communications, or records. File a motion to enforce the order, clearly stating the reasons and supporting evidence. Attend court hearings and present your case, bringing all relevant documentation. Consider requesting legal representation for your children to ensure their best interests are represented.
