Q: Can charges get dropped if my BF takes a lie detector test to show his intent for the crime are bogus?

My BF was arrested when the police showed up ans said he was in the video of a home burglary. No investigation, no warrant. Just a "we belive this is you so your under arrest" he has been in jail for almost 3 weeks and still hasn't been assigned or able to get an attorney. The da says his intent on this burglary was a potential sexual act on the homeowner that apparently was home during this incident. If my bf takes a lie detector test now somehow, does the da have to drop the charges?

Answered

A: The decision to drop charges rests with the prosecutor's discretion, and it typically involves a variety of factors beyond the results of a lie detector test. The prosecutor will consider all available evidence, witness statements, police reports, and other relevant factors before making a decision.
