Lucerne Valley, CA asked in Criminal Law, Family Law and Domestic Violence for California

Q: I had a no contact order against my husband at the time for myself and our son.

I was escorted by police officers to two locations, the second is whee my husband and son were located. The officer knocked and when he answered he asked if there was a custody order the officer replied yes, and my husband told the officer to "f*** off and get off his property.then slammed the door in his face. The officer asked his partner " what now". And then I was told to go to court to get an order and I told them they had the order , they didn't see my son to ensure he was ok nor did they remove my son from his father and return him to me as the court order I had stated he was to have no contact with my or my son. I have video recording of this exchange between officers and husband, I went back to court the next morning asking for an order to have my son removed and I was told that was what I already had.An officer thenescorted me to my mother in laws made her give my son to me.can I sue for the officer the night before. What if my son was harmed. Husband has violent convictions

A: If you believe that police officers failed to enforce a no-contact order and potentially put your son at risk, you may want to consult with a legal professional who specializes in family law or domestic violence cases. They can help you assess the situation and determine if taking legal action, such as filing a complaint against the officers or pursuing a lawsuit, is appropriate. Providing evidence, such as the video recording you mentioned, could be crucial in supporting your claim.
