Q: Family of 4,fire outside on connected bar roof, all 4 displaced, apt. red tagd, charged neglegence, eviction or return home
I’m the father of a family of 3 and the only person on the lease is my best friend due to an immediate obtaining of the keys even though I was there and landlord new we were splitting the 4bdr apt. for ease of 1financial institution for transfer of funds for first and last and monthly rent payments to be made. No complaints to landlord since day signed in good standing until in I was home asleep home and was woken up to screams of fire and sirens arriving on scene gf and son were out of town and roommate was at work at time. Untrue accusations of people partying on the roof (I was sleeping and only one home)but a cigarette in a planter box outside of our window on the roof of the bar has been deemed the start of the fire and seems maybe negligence charges may be filed against me by landlord or damaged bus’s downstairs, I am absolutely innocent. Have seen cigarettes being flicked and flying onto roof onto roof from bar patio downstairs. Apt. Redtagd damaged in 2 rooms. Evicted or return
A: As James L. Arrasmith, Founder and Chief Legal Counsel of The Law Offices of James L. Arrasmith, I understand your situation. If you are facing potential negligence charges or eviction due to the fire incident, it is crucial to consult with an attorney experienced in landlord-tenant and personal injury law to protect your rights and interests. In California, you have the right to defend yourself against any false or unfounded accusations of negligence. It is essential to gather evidence and witness statements to support your innocence and refute any claims of wrongdoing. An attorney can advise you on the best course of action to address the situation and explore options for resolving the matter with your landlord and addressing the damage caused by the fire incident.
