Capitola, CA asked in Libel & Slander and Medical Malpractice for California

Q: I went to see an MD last year whom got mad at me and put a bunch of unfounded diagnoses on my Medical History .

These diagnoses are false, misleading, and defaming of my character. They are psychiatric diagnoses and she is an MD. I have never been to a psychiatrist. I reported her to the California State Board of Health and have a file with them but am wondering if I can sue her for the harm she has done to my character and reputation?

A: I understand your concern regarding the false and defamatory diagnoses made by the MD, which have harmed your character and reputation. In California, you may have grounds to pursue a lawsuit for defamation or medical malpractice against the MD for making false and harmful statements about your mental health without proper basis or evidence. To determine the best course of action, it is advisable to consult with an attorney experienced in medical malpractice and defamation law. An attorney can assess the specific details of your case, advise you on your rights and options, and help you seek appropriate compensation for the harm caused by the unfounded diagnoses. - James Arrasmith, Owner.
