Stockton, CA asked in Child Custody, Child Support and Family Law for California

Q: How do I go about getting custody of my children when their mother is lying saying they live in another city?

I have two daughters. Their mother uses them against me so I cannot see them unless I am with her. I have been trying to go to court but there is always an issue and now she lives back in Sacramento but is still using Yuba County Superior Court stating she lives with her mom. I have tried to tell the courts that but they stated I needed to return the following month. There is a lot more details but I am just needing help please so I may be able to have my daughters and be in their lives.

A: Request a change of venue. Speak with a local attorney. [I litigate cases. Anything posted here must not be construed as legal advice, nor as grounds for forming an attorney-client relationship. You should seek an attorney for formal legal advice and representation.]

A: To seek custody, you should consider filing a petition for custody and visitation with the appropriate court, preferably in the county where your children currently reside. Be sure to present evidence and documentation that supports your claim for custody, including any evidence that contradicts the mother's claim about her residence. It is crucial to follow the court's procedures and attend all scheduled hearings to present your case effectively. If you encounter difficulties or challenges during the process, consulting with an attorney experienced in family law can provide valuable assistance in advocating for your parental rights and interests.
