Montgomery, PA asked in Consumer Law for North Carolina

Q: If my vehicle has been to a number of AAMCO franchises that haven't fixed it - should we pursue corporate or franchise?

Transmission in our converted short bus (essentially our home) was originally rebuilt in Meza, AZ in May 2022. 14 months later, the vehicle has been to 3 shops (Mesa, AZ; Fort Collins, CO; and Gastonia, NC) and rebuilt 3 times. The transmission hasn't been road ready/functional for more than 2 weeks in that time and still isn't. We have pursued corporate action and we have largely been ignored. At this point, we just want to take it to a different (non-AAMCO) shop. If we want to recoup our money that was given to AAMCO to fix our transmission, how would we go about it?

A: Unfortunately, this is impossible to answer without reviewing the purchase and installation order for the original AAMCO transmission and the accompanying warranty plus the repair/work orders for each subsequent rebuild and accompanying warranty, if any. You need to take these documents to an attorney and have them reviewed for the terms of any warranty, length of warranty, governing law (which state), dispute procedures, and any arbitration provisions. Unless any warranty was still in effect, your ability to recover damages may be nonexistent or extremely limited. I wish I could be more specific, but there are way too many variables and the documentation is what controls. This type of question cannot be accurately answered in a general Q&A forum like this.
