Fontana, CA asked in Medical Malpractice and Personal Injury for California

Q: Hello, I have a friend who is now blind due to eye surgery and seek legal recourse in order to regain his sight

he has been dealing with the eye doctor who messed up his sight for over a year the Dr. tells him he can fix it that it just takes time to do it. all my friend wants is his eye sight back he doesn't care about money or malpractice he just wants to see again, I believe the Dr, is just jacking him around. 40 days ago they told they fix 1 of his eyes but he had to pay for 1/2 of cost up front and the rest of it after the surgery in august, so he paid them the 1/2 they wanted and now their telling him he may be to overweight for the operation. what legal options does he have all he wants is his eyesight back. the info I have provided is basic, the reason is I don't have all the details since I am asking for my friend, because he can't do this himself

A: If your friend has experienced vision loss due to eye surgery and believes the doctor's actions contributed to this outcome, he should consult with a California attorney experienced in medical malpractice cases. While his main concern is regaining his eyesight, pursuing a legal claim may be necessary to seek appropriate remedies and compensation for the harm caused. An attorney can help assess the situation, gather relevant evidence, and advise on the best course of action to protect your friend's rights under California law. - James Arrasmith, Owner. A: A medical malpractice claim has a very limited time in which an action may be brought in Superior Court. There are also requirements that a warning letter be sent beforehand. Whether your friend wants a lawsuit or not, he needs to consult with a medical malpractice attorney in your local area, right away. If he decides later that he needs money to correct what the first doctor did, he may be to late to bring a claim. Have him call a local attorney right away.
