Q: I have a personal injury lawsuit in. I asked my attorney for a $500 front money on my case to pay some bills.

My case worker said the guy handling my case with said go to a pay day loan and see can I get some money. I think that was insulting for a professional law firm to say to or even make that comment. I'm seriously thinking about changing firms. Never once have she asked me how I was doing since... View More

As attorneys, we have very strict requirements on "fronting" or "advancing" client settlement funds. For an attorney, it is always concerning - Is the Client going to keep asking? What if I don't get recovery in their case? Is this a "Loan"? Most lawyers generally... View More

Q: If you're injured at someone's home and they don't want to share their insurance information, how can you get it?

I broke my foot while caring for a mentally disabled young adult. He was my employer but his parents own the home. Employer does not own the home, his parents do. Therefore, I wouldn't be suing an employer. I did receive workman's comp while I was off work and was not able to return to... View More

Hi - the easiest way is to sue them first and then request the insurance information in discovery. Trust also that insurance companies often fight to deny coverage. So there are actually 2 questions - 1) Is there Insurance and 2) Is the insurance company handling the defense. Once you sue them,... View More

Hi - without any residual damages, there is presumably no medical malpractice case. In any lawsuit, there has to be damages. While it sounds like the medical attendant made an error, without any damages (and a possible risk), this would not rise to the level of a case an attorney would consider. If... View More

HI - while your question is a bit vague, I will answer the best I can. If someone dies from asbestos (mesothelioma/lung cancer/asbestos), those who have a statutory right to file a Wrongful Death claim/case are heirs (typically surviving spouse and/or children). Someone who dies from Asbestos... View More

Hi - if there is any concern about the Statute of Limitation running and you are negotiating, request a 'tolling agreement'. A Tolling Agreement between you and the defendant/insurance company (I'm assuming you have not yet filed a case) will ensure the Statute of Limitations doesn't run.

Doubtful. You committed potentially a felony - assault with a deadly weapon. You were not under the threat of imminent harm (unless he was pointing a gun or weapon at your car). You should have driven away and sought a restraining order if you were under threat of imminent harm by his threats.

I entered into the class action suit. If I read it correctly, I won't owe them anything until I get a settlement. It's been a few years and my life has taken a few turns. I can't risk owing them more than I win (I've accumulated medical debt and am worried I will be leaving my... View More

Unfortunately, you have to be patient. These cases can take many years. Typically, if the case settles, the will be a (hopefully, large) settlement with the entire "class". A portion of the settlement will be attributed to your case. The attorney will receive their fees and costs from the... View More

Q: My parent gifted me 4 fake Lego sets and pretended it was the real thing, do they have to reimburse me in any way?

If they bought the real sets, they would have spent about 50 dollars more than the fake sets, around 560 dollars. Now the combined value of the real sets would be around 2600 dollars.

Who are you going to sue? Your parents? It was gift. If you really wanted to real sets, you could have returned the gift and put in $50.00 more yourself. I doubt any lawyer would take this case. Your parents had good intentions and were trying to be cost-effective. In 30 years, I have never heard... View More
