Los Angeles, CA asked in Child Custody and Family Law for California

Q: What can I do to get my child back?

When my ex was 6 months pregnant with my child, caught her screwing with her ex husband so the next day she went and got a temp. restraining order against me and my house, not hers, & got me kicked out. 2 days later she moved her ex into my house. She then moved to north Carolina & gave birth to my son a month ago. I have no contact & the only reason I know she's there is because of a mutual friend. She is trying to say that the baby is his & whether he believes it or not I don't know but she lied on her conception date by a month & the baby was born a "month early". In reality the baby was born on time. Her friend sent me a text convo she had with my ex with her saying "she wished it was her ex husband's baby not Jeremy's" I'm Jeremy. My ex & her ex husband are nuts and have already gave up 1 child for adoption at 3yrs old. Im in California, she moved to get away from me knowing I wanted custody.

A: To pursue custody of your child, you should immediately file a paternity action in a California court, seeking to establish your legal rights as the father. Once paternity is established, you can request custody and visitation orders. Given the complexities of interstate child custody issues, it would be prudent to retain an attorney familiar with the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) to navigate the legal process.
