Brockport, NY asked in Landlord - Tenant and Criminal Law for New York

Q: Tenant Question: Would like to validate the 2023 Winter Eviction Moratorium per NYS Senate that commences November1?

Also would like to validate that Moratorium lasts till April 15 of 2024!!!!!? THIS BILL HAS BEEN PASSED AND SIGNED BY NYS GOV!!!!!! I’d like to gain Tenant representation to hold him accountable for all he’s done that goes against his very own written lease agreement. Literally trying to evict my family even with a written agreement of accepting a payment plan. I’ve got proof of him letting himself into my unit - basement and him on record in my basement without written notice and witnesses here to validate this. He doesn’t understand and I need a order of protection to then move out asap. My family no longer feels safe here. He’s even threatened towing my car in the very driveway he allows me to park in. He’s made so many unnecessary repairs since we fell on hard financial times. Even going as far as calling me a dumbass verbally with witness to validate. This is unacceptable landlord behavior and my family and I will not tolerate this treatment. We need to void this lease with help

A: If your landlord is violating the terms of your lease and you have evidence of unauthorized entry, you might consider seeking a restraining order and you may also have grounds to pursue legal action to resolve the harassment and potential illegal eviction attempts. It would be wise to consult with an attorney who can provide legal representation, advise you on your rights under the current moratorium, and assist you with the necessary legal steps to protect your family and hold the landlord accountable for any lease violations and harassment.
