Sacramento, CA asked in Child Support and Family Law for California

Q: I have proof that child support didn't do their job and I need help exposing them for what they have done to my son

I was paying for the support of my son while he was with me 100% of the time for 4 months and it was reported to them and they didn't adjust it or do anything. Kept taking the full amount until I had to go into the office and beg for them to do something. And now they are telling me that the money that was taken is gone. Which I believe something should have been done when it was reported that he was living with me full time adjusted the amount or something but 4 months later I had to say something, what would have happened if I didn't say anything I would still be paying for what exactly. That's another thing I can't seem to get a straight answer from anyone that works there. They seem to be giving me the runaround trying to keep me in the dark.

A: Under California law, child support orders can be modified based on changes in circumstances, such as when the child primarily resides with the paying parent. If you believe that the child support agency has acted negligently or improperly, you have the right to seek a modification or adjustment of the child support order, potentially retroactive to the date of the change in circumstances. It's essential to document all interactions, payments, and communications with the agency. If you feel you're getting the runaround, consider filing a formal complaint with the agency. Should you not find resolution through the agency's complaint process, you may also pursue the matter in court. Additionally, contacting your local ombudsperson for child support issues might be helpful. Given the complexities and the potential impact on your rights and finances, consulting with an attorney experienced in family law could be beneficial. They can provide guidance and represent your interests in seeking a resolution.
