Q: What are typical settlement amounts for whiplash sustained in a fender bender car accident?
My brother is being sued for $1 million because 2 years ago his 16 year old son rear ended a car at a stoplight just after he got his license. The two passengers are both claiming to have permanent injuries due to whiplash. The complaint was filed a day before the statute of limitations would apply. His insurance company will only pay up to $100,000. I'm trying to get some information on how cases like this tend go, such as what the average payout amount is and what would be the high end. The insurance company's attorneys are handling it, and so far not much information is being shared by them. Shouldn't my brother have a right to be kept in the loop and see all the evidence? This is very stressful for him.
A:
There is no amount that can be determined without looking at all the facts.
You should hire your own attorney to make the insurance cover you and make sure they settle the case.
A: It's difficult for anyone to speculate the merits of their case without knowing more about the injuries, medical documentation supporting them, and level of disability. Your brother should be kept in the loop. He may even be advised by his carrier to consult independently with an attorney. Good luck
