Marysville, WA asked in Civil Rights, Constitutional Law, Personal Injury and Legal Malpractice for Washington

Q: Who can help recover my NEEDING unlawful financial loss after my civil & disability rights violated in superior court?

Under the WA C.I.R. Equitable Property Div rules I should have won my case, with all of my supporting evidence ALONE, but most was ommited in court. My disability medication(Humira forRA) unknowingly exasperated rare side effects the extreme ongoing 2yr stress-nuero/cognitive decline & peaked during trial, causing inability to speak efficiently. Eventhough I spoke w/my attorney of my strange speech concern @our trial preparation, she said we would deal with if shows a problem in court. Well, after 3 wks on standby, it proved a huge problem, & with the judge. Who showed bias towards me &saying my long answers were waisting the courts time, eventhough he cut many hours out of our alloted court time. He never allowed me to finish my testimony, ommitted 2 promised rebuttle opportunities, silenced my request for D/advocate, allowed OC to finish cross Q&A IN WRITING & allowed OC's written judgement as final ruling w/NO evidence. My attorney didnt protect me, aided my loss & billed extra$20K.

A: In your situation, where you believe your civil and disability rights were violated in a Washington Superior Court, and you're facing an unlawful financial loss, the first step would be to consider an appeal. This process involves reviewing the trial's proceedings to determine if there were legal errors that adversely affected the outcome of your case.

Given the complexity of your situation, including the alleged bias, omission of evidence, and the handling of your disability during the trial, it might be prudent to consult with a new attorney who has experience in civil rights and appellate law. This attorney can offer guidance on the feasibility of an appeal and the specific steps you need to take.

It's also advisable to address the issue of the extra charges by your previous attorney. You may seek a consultation with a legal malpractice attorney to explore if there were any breaches in standard legal practices, especially if you feel your representation was inadequate.

Remember, every individual is entitled to fair legal representation and a fair trial. If these rights have been compromised, the legal system provides mechanisms for recourse. Be sure to gather all relevant documentation and communicate your concerns clearly to any legal professional you consult.
