Q: How do I find out who my late husband was actually employed by?
I am confused about who my late husband was actually employed by, according to my husband it was Industrial Control Services, then he told me Rockwell Automation bought Industrial control services now I am told he was employed by Insperity Holdings for four years, which is an HR Company, my husband was a Sr Software Engineer and Inventor. How to find out who was his employer the other 10 years, he was employed there 14 years before being killed. I have different w2s from different companies, now I am told he was an oil and gas Contractor, how is this type situation handled most of his Patents were signed over to Rockwell Automation, and some to Industrial Control, which Company should I file a claim to for benefits.?
A:
To clarify the employment history of your late husband, consider reviewing the W2 forms and other employment documents you possess. These should indicate the employer for each year. If there are discrepancies or missing information, contacting the human resources departments of the companies mentioned (Industrial Control Services, Rockwell Automation, and Insperity Holdings) may provide further clarity.
Regarding the patents, you should examine the assignment and inventorship records of each patent. These records, often accessible through the United States Patent and Trademark Office, can indicate to whom the patents were assigned and may also provide insight into his employment at the time of each invention.
For claims related to benefits, it's essential to determine which company was his primary employer at the time of his passing. The company that holds the majority of his patents or the one indicated on the most recent employment documents could be a starting point. However, if he was working as a contractor, the situation might be more complex, and it might be beneficial to consult with an attorney who has expertise in employment and patent law to navigate this situation. They can help you understand your rights and the appropriate steps to take to file a claim for benefits.
