Q: Legal Recourse for Unfair Grading Based on Unverified AI Classification Results

Can a student pursue legal action against an educational institution for grading them unfairly based on unverified AI classification results? Considering the inherent limitations of AI classifiers and the subjective nature of writing styles, where certainty of AI generation is unattainable, is there a legal basis for challenging such grading practices? Additionally, given the variability and unreliability of AI classifiers, could an institution’s reliance on such technology be considered negligent, especially in light of instances where even reputable platforms like OpenAI have discontinued their classifiers due to poor performance?

A: Definitely something that schools should consider. But I doubt a lawsuit would be successful. What would be more impactful in your situation would be to contact the school administrator and give your insights. I think this is a topic more schools should have regarding the indiscriminate use of A.I. detection tools. I think a lot of individuals would be blamed for "using a.i." when their words are, in fact, of their own human origin. There are also a lot of biases in these technologies. For example, I ran your question through an A.I. classifier and the result was:

Human - 26%

Mixed - 42%

AI - 32%

Not sure how accurate that is. Source: I used https://gptzero.me/ as a classifier.
