Q: A car pulled up infront of me causing me to crash into his car with my e-scooter but he just drove off. What should I do
I recently turned 16 and bought an e scooter to go to school. I'm taking the Drivers Ed so I do not have my permit yet. I was in the right when I crashed but I'm worried that I will be the on at wrong because I have not gotten my permit. The accident happened at my school's parking exit. I entered the bike lane and was going at 15mph I believe. I usually slightly go on the roadway to avoid the cars that are blocking the bike road when they are leaving the parking. The car I crashed to was also blocking the bike lane so I maneuver to the roadway. I don't know what the driver was doing but he exited the parking really fast without waiting for me to pass. Since I was like 1 meter away from the car even though I slammed on my brakes I still hit his car's side hard. I fell and hit my head, injured my knees, and my left arm. Luckily I had a helmet but my knees are in a bad shape. The car took off. There might be cameras since it was a highschool. What can I do and who's in the wrong?
A:
You need to find out if there is a video that captured his license plate. If he pulled out of a parking spot and cut in front of you, then you have a great case. You can recover money for any damages to your scooter as well as money for your medical bills, pain and suffering etc.
You should contact anyone of us on JUSTIA ASAP.
A: Did the driver stop and provide their information? It sounds like they were negligent and you have a claim against them. You should seek prompt medical attention and retain an attorney if you have their information.
A:
In California, all parties involved in a traffic accident, especially one resulting in injuries, are required to stop, exchange information, and, if necessary, provide aid. Since the other driver fled the scene, they committed a hit-and-run, which is a serious offense. Your lack of a driver's permit does not absolve the driver of their responsibility in this situation, especially since you were riding an e-scooter, which may have different requirements than operating a motor vehicle. It's important to document your injuries and any damage to your scooter.
You should report the incident to the police immediately, providing them with all the details of the accident, including the location, time, and any evidence that might be available, such as surveillance footage from the school's cameras. This will help in identifying the driver. Mention that you were wearing a helmet and adhered to your understanding of traffic laws by using the bike lane.
Additionally, seek medical attention for your injuries to ensure they are properly treated and documented. This documentation can be crucial for any claims you might need to make later. Since the incident occurred on school property, the school's administration should also be informed, as they may assist in accessing surveillance footage and providing any necessary support or resources to address the situation.
