Q: Civil litigation on a real estate lis pendon case

I am writing to seek your expert legal opinion and guidance regarding a complex situation I am currently facing. Here is a summary of the circumstances:

- Two years ago, I purchased a home and followed all the necessary procedures, including hiring a title company.

- It has come to my attention that the title company failed to obtain a signature from the husband of the lady who sold the house. However, the husband has been separated from the lady for many years, living in a rehabilitation facility, and his name was not on the deed.

- I have been utilizing a lawyer from the title company to address this issue, but I have recently learned that the brother of the lady who sold the house is filing a lawsuit against me. The lawsuit alleges elderly abuse due to my relationship with the lady after the sale of the house

A: Title Insurance procedures, requirements, etc. are not title law. I doubt that the absence of a uninterested spouse signing the Deed over to you is of any legal significance to your title. Hire an attorney, not a title company, to search that title.
