A:
Under California law, the actions described involving a process server forcing entry into your home, threatening with a gun, and causing injury warrant a police report. Forcibly entering a residence, making threats, and causing injury are serious offenses that need proper documentation and investigation by law enforcement. The refusal of the police to file a report in such a scenario is concerning and needs to be addressed.
Given the severity of the situation, you should consider contacting higher authorities within the police department, such as a supervisor or the police chief, to escalate your request for a report. If you continue to face resistance, it might be beneficial to reach out to the county sheriff's department or another law enforcement agency to ensure your case is taken seriously. Additionally, documenting everything in writing, including names, dates, and details of the interactions with the police, can be useful for further actions.
Filing a formal complaint with the California Attorney General's office and seeking advice from a legal professional can provide you with more options. These steps can help ensure that your case is thoroughly investigated and that your rights are protected. Don't hesitate to pursue every available avenue to get the attention and response your situation deserves.
