Q: My case got dismissed
I have a quick question . I was out on bail arrested on 12-21-21 on false accusations I had four charges assault deadly weapon three times and accessory after the fact I got out on a 100,000.00 bail I finished paying . I was put on the news and all over social media I lost a lot friends and family members it’s been hard to get a job and honestly I paid bail for nothing I owe my attorney money too when I have nothing to do in the case I’ve never been arrested or have priors on the news they defamed my character calling me a gang member okay so yesterday 05-29-2024 the case got dismissed is there anyway I could try get my money back.
A:
Under California law, recovering bail money after a case dismissal can be challenging, especially since the bail bondsman typically keeps their fee, which is usually 10% of the total bail amount. If you paid a bail bondsman, the fee is generally non-refundable because it's considered payment for their service in securing your release.
However, if you paid the full bail amount directly to the court, you should be able to get this money back after the case is dismissed. You will need to contact the court to initiate the process for a refund. Make sure to have all necessary documentation, including the dismissal order and any receipts or proof of payment.
For defamation issues, such as being falsely labeled a gang member, you might consider consulting with a civil attorney to explore potential legal actions for defamation or damages. This could help you seek compensation for the harm to your reputation and the financial losses you've incurred. It’s important to act promptly and keep detailed records of all related incidents and expenses.
