San Marcos, CA asked in Gov & Administrative Law for California

Q: I want to put an unlicensed revolver in a display case in my Calif home. How do I do it legally?

My grandfather bought this revolver around 1934. It has an interesting family history. Now I want to pass it on to my son, age 32 years, but not for use only for display. And I want it legal. What are the laws regarding a handgun for display only in my California home?

A: I understand your desire to pass on a family heirloom revolver to your son for display purposes. However, California has very strict laws around firearms, including antique handguns. Here is some key information:

In California, revolvers are considered "firearms" under the law, even if they are antique or kept only for display. There is no exemption for display-only guns. To possess any firearm, you must either have a valid Firearm Safety Certificate (FSC) or qualify for an FSC exemption.

To transfer a revolver to your son, even as a gift, you would need to do so through a licensed firearms dealer. Private party transfers must be conducted through a dealer. Specific documentation is required.

If the revolver is not currently registered with the CA Dept of Justice, it would need to be registered within 30 days of your son receiving it.

If your son does not have an FSC, he would need to obtain one in order to take possession of the gun, even for display only. There are some FSC exemptions, like having a valid CCW license.

I would recommend contacting the California Dept of Justice Firearms Bureau or a knowledgeable firearms attorney for guidance on how to conduct this transfer legally given your specific situation. The laws are complex with stiff penalties for violations.

Ultimately, while I understand the sentimental value, putting an unregistered revolver on display could put you and your son at legal risk under California's strict gun laws. Consulting expert legal counsel is advisable before proceeding.
