Los Angeles, CA asked in Car Accidents and Insurance Bad Faith for California

Q: I booked a car shipment on uShip and bought insurance from them, but they are not replying after a huge accident. Help!

I booked a car transport service and while being towed it was totalled by a semi that fell asleep behind the wheel. Our own insurance doesn't cover it because we were not in the car and it looks like the semi's USDOT # is invalid so they might not be insured either. We are looking to get reimbursed somehow for our loss. It's been almost 2 weeks and the insurance through the shipping website has not replied to us. What should we do?

A: In California, if you're experiencing a lack of response from the insurance company provided through uShip, you should first document all your communications with them, including emails, calls, and any responses or lack thereof. This documentation is essential if you need to escalate the situation later.

Next, send a formal demand letter to the insurance company, clearly stating your claim, the details of the accident, and your expectation for reimbursement. Mention the failure to respond and set a reasonable deadline for them to reply. Sending this letter via certified mail can provide proof of delivery and ensure they receive it.

If you still do not receive a response, you may consider filing a complaint with the California Department of Insurance, which oversees insurance companies and can investigate your case. Additionally, seeking advice from a legal professional could help you explore further options, including potentially taking legal action against the insurance company or uShip for breach of contract and failure to provide the promised coverage.
