Austin, TX asked in Contracts, Business Law and Employment Law for Texas

Q: How can I recover unpaid commissions?

Facing closure, my former employer and I agreed on a commission-only role to keep me on board. I successfully brought in several clients, including their largest ever, a multi-million dollar deal. After receiving a partial commission for this deal, communication and transparency around client work significantly decreased. I later discovered I was excluded from client communication and misled regarding ongoing work. Despite this, I continued generating business. Two years later, I learned the large client I brought in was still a major source of revenue, but efforts were made to conceal this. This client now fuels their multi-million dollar business.

My concerns:

* Unpaid commission: I believe I'm owed full commission for the initial large client deal and potentially others.

* Misrepresentation: The company misled me about ongoing work with the client, hindering my ability to pursue further business.

A: A Texas attorney could advise best, but your question remains open for two weeks. One option is to review your matter with a Texas attorney. The first thing they'll ask, which is not mentioned in your post, is whether you had a written agreement as to your commissions. That would be valuable. If you have records of your communications, those would also be valuable. Discuss the basis on which the matter would be handled (contingency, hourly fee, etc.), and ask if it would be cost-effective and viable to pursue your legal remedies here. Good luck
