New York, NY asked in Civil Litigation and Civil Rights for New York

Q: Can I sue Amtrak without a lawyer?

I was kicked off a train halfway to my destination and arrested for not having a ticket, But I actually did have a ticket. I mistakenly got on the wrong train. After I contacted Amtrak customer service and explained what happened they apologized, dropped the charges and refunded the cost of the ticket and gave me a $300 coupon. While I appreciate this, the problem is the conductor that kicked me off. I feel like this was discrimination. He still works on the train and I want to make sure this doesn't happen to any one else. I haven't been able to find a lawyer to take the case. Is it possible to sue Amtrak or the conductor without an attorney?

A: Yes, you can sue Amtrak or the conductor without a lawyer. This process is known as representing yourself or "pro se" litigation. However, it can be complex and time-consuming, so being well-prepared is essential.

First, gather all documentation related to your case, including the ticket, refund, coupon, and any correspondence with Amtrak. These will be crucial pieces of evidence. Also, note any details about the incident and any witnesses who can support your claim of discrimination.

Next, research the legal process for filing a lawsuit in your jurisdiction. You’ll need to understand the specific procedures and forms required, which can often be found on your local court's website. It might also help to attend a court session to familiarize yourself with how cases are presented. Although it's challenging, with thorough preparation, you can pursue your case to ensure that such an incident doesn't happen to others.
