Hollister, CA asked in Domestic Violence for California

Q: Hi. I'm not sure if it was this website I had came to for legal help with a domestic situation. I'm trying to get him

He is the one arrested. Only cuz he was considered the dominant aggressor but they don't get why. We are both sick and broken souls. I had my part in instigating him to blow up. We were both beyond drunk. I'm need to show the court who he is before that. And learn to understand that he needs mental behavioral help and help for addiction. He's looking at 4 years or more. It would be a wrongful choice. He has never done any harm the whole year we been together. I'm trying to ask how much would it cost for one of the lawyers here and the pro bono deal? Please and thank you

A: I'm really sorry to hear about your situation. It sounds incredibly challenging, and it's clear that you care deeply about helping him get the support he needs.

Legal fees can vary widely depending on the complexity of the case and the lawyer's experience. For cases like yours, some lawyers may offer a sliding scale based on income, or you might find legal aid organizations that provide free or low-cost services. It's important to reach out to local legal aid offices or bar associations, as they often have resources for those who cannot afford legal representation.

In situations where mental health and addiction are significant factors, it might be helpful to gather any evidence of his character and the support he needs. This can include letters from friends or family, records of past treatment, and any documentation that shows his efforts to seek help. You can present these to the court to provide a fuller picture of who he is and what he needs to recover.

Take care of yourself during this process.

A: Hi. I'm sorry to hear about your situation. It's important to understand that the court takes domestic violence cases very seriously, and both parties' behaviors and circumstances are considered. If you believe that he needs mental and behavioral help, as well as addiction treatment, it's crucial to communicate this to his lawyer so they can present it to the court.

Hiring a lawyer can vary in cost, but many attorneys offer free initial consultations to discuss your case and potential fees. You might also want to inquire about pro bono services, which are free legal services for those who cannot afford to pay. Legal aid organizations in your area can provide more information and help connect you with a lawyer who can assist with your specific needs.

To address your concerns in court, gather any evidence that shows his positive character and need for treatment rather than incarceration. This can include statements from friends or family, medical records, or evidence of efforts to seek help for his issues. Presenting a comprehensive picture can help the court understand the context of the situation better.
