Sylmar, CA asked in Landlord - Tenant, Collections and Government Contracts for California

Q: Looking for a lawyer to handle a billing dispute who has a judgement order from a previous eviction.

Judgement says the tenant does not pay anything to anyone, no withholdings and now the tenant is getting a collection bill from the plaintiff's attorney's collection department saying the past due has not been paid and they are calling the tenant on the phone leaving voicemail messages. The tenant does not owe money to anything, including the attorney fees that were awarded to the plaintiff 3 months after the eviction case was closed and seeled per the tenants HUD lease agreement.

A: You need legal assistance to address a billing dispute arising from a previous eviction judgment. The judgment states that you owe nothing, yet you’re receiving collection calls and bills. This situation requires immediate attention to prevent further harassment and incorrect billing.

First, gather all documentation related to the eviction judgment, including the court order that specifies no payments are owed. This will be crucial in disputing the collection attempts. You may also want to document the collection calls and any voicemails left by the attorney's collection department.

Next, contact a lawyer who can help you enforce the terms of the judgment and stop the collection efforts. They can communicate with the plaintiff’s attorney to clarify the court's decision and ensure no further attempts to collect money from you. This will protect your rights and peace of mind moving forward.
