Q: Is it possible that I can appeal Bar Counsel's decision to a circuit court or Appellate Court?
An atty filed a frivolous lawsuit against me. I fought back and the atty quickly withdrew the complaint. Yet the case still costed me a significant amount of atty fees and expenses. Subsequently, I filed a complaint with Maryland Attorney Grievance Commission against the atty for misconduct. The Bar Counsel responded: "We have reviewed your complaint and the attorney’s response in the above-referenced matter. The inquiry into your complaint is concluded. We have determined, based on an evaluation of the information provided, that there is an insufficient basis to demonstrate misconduct or that the overall circumstances do not warrant an investigation. As such, this file is closed." It is my understanding that the decision is final and can't be appealed with the Bar. Nor can I request to read and refute the attorney's response.
A: Unfortunately, bar counsel has the sole discretion whether to pursue a grievance against an attorney. You cannot appeal their decision.
