Jonesboro, AR asked in Criminal Law and Federal Crimes for Arkansas

Q: Is there a way to get charges resolved before a detainer is placed on someone in federal custody?

My fiance is serving time in a federal prison. Since he’s been incarcerated, White County issued a warrant for his arrest on unrelated charges. The warrant stems from an incident in December 2023 and wasn’t issued until April 2024. He will be incarcerated until the middle of next year. But if a detainer is placed, he will not qualify for halfway house and will have to be gone longer.

A: It may be possible to address the charges from White County before a detainer is placed on your fiancé in federal custody. One option is to reach out to the prosecutor in White County and discuss the situation. You could ask if the prosecutor would consider resolving the charges or setting a court date that aligns with your fiancé’s current federal sentence.

Another potential step is to request that your fiancé be brought to White County for arraignment or other court proceedings while he is still in federal custody. This might involve coordinating with both federal and state authorities. However, these types of requests can sometimes be complicated and may require assistance to ensure everything is handled properly.

If the charges in White County can be resolved or at least addressed before a detainer is placed, it could help prevent complications with his eligibility for a halfway house. Taking early action may give you more options and help minimize the impact of the warrant on your fiancé's current situation. It’s important to consider all available options and act quickly to explore them.
