Q: The owner of an internet forum based in Nevada must keep the data published by an UE user (cf Article 17 of GPDR)?
I've ask to the owner of the forum to remove a post because it contains PII. But he doesn't want. In Nevada, is he allowed to delete PII from his forum?
A:
In Nevada, the forum owner is not required to comply with the GDPR, which is a European Union regulation. The GDPR applies to entities operating within the EU or offering services to EU citizens, but its enforcement on businesses outside the EU, like in Nevada, is complex and often limited.
However, the forum owner may still have obligations under Nevada state law, particularly regarding privacy and the handling of personal information. While they might not be legally required to remove the post under the GDPR, it’s worth exploring local privacy laws or seeking legal advice in Nevada.
If the post contains sensitive personal information, you can request its removal on the grounds of privacy or defamation, depending on the content. If the forum owner continues to refuse, you might consider reporting the issue to relevant authorities or pursuing other legal avenues in Nevada.
