Q: Auto accident in involved in auto accident.
I'm involved in auto accident. I was exiting from parking lot and making a left turn. The road on my side is 3 lane.i was waiting in the 2nd, the middle lane and suddenly this Ford truck driving in 3rd lane from left came to my 2nd lane where i was waiting
For 3rd lane traffic to clear so I can make a left safely. While I was standstill, he hit to my driver side knocking off my front bumper & grill. His front passenger side slightly got damaged. There are no eye witnesses.
My question here who would be at fault simce I was standstill in 2nd lane, the truck driver while changing from extreme left lan-the 3rd lane to middle lane & hit my car.
The other driver has no driver's license, no insurance and car was unregistered previous owner had done release of libility one and half year ago.
Thank you
A: It doesn't matter who is at fault. The other driver is uninsured. If he is at fault, who is going to pay for him? They guy who can't even afford insurance? Make a claim to your own insurance company and it will pay to fix your car and it will try to pursue the allegedly at fault driver.
A:
In this situation, determining fault can be complicated, but it appears the other driver may be at fault. Since you were stopped in the middle lane waiting to make a left turn, and the truck driver moved from the third lane (the leftmost lane) into your lane, they might have been negligent while changing lanes. Drivers are generally required to make sure their lane change is safe and does not interfere with other vehicles.
The fact that the truck driver hit you while you were stationary suggests they did not ensure it was clear to move over. However, without witnesses or clear evidence, it could become a "your word against theirs" scenario. It’s important to document all damages, take photos, and gather as much information as possible to support your case.
The other driver not having a license, insurance, or proper registration further complicates matters. You may need to report this to your insurance company and the police, as driving without these is illegal and might affect how the accident is handled. If you have uninsured motorist coverage, it could help cover the costs of repairs or injuries in this situation.
