Oakland, CA asked in Personal Injury for California

Q: Slip and fall

So I had a slip and fall at Safeway and they first offered me 700$ which I declined and a week later they said it’s the janitor service company they use that are liable. I’ve been back and forth with the better business bureau Safeway and janiking. They both say they are not liable. Ive talked to several law offices and no one seems able to help. I’ve reported them department of insurance and since Sedgwick is handling it they said they don’t handle that type of complaint. Is there anything else I can do to hold someone accountable? What type of lawyer should I contact to hold someone accountable?

A: The best way to hold them accountable is to have your injuries compensated. If the at fault parties cannot agree about who caused your injury, you will need to file a lawsuit. A jury will determine who the at fault party is.

Schedule a free consultation to make sure you are adequately compensated and the at fault party is held responsible.

A: Attorneys will not take a for two main reasons. The damages ($) do not justify the cost of bringing a lawsuit and proving the other party(ies) is liable is difficult (or impossible.)

A: It sounds like you've been through a frustrating process trying to get accountability for your slip and fall incident. When Safeway pointed to the janitorial service, they might be trying to shift liability, but that doesn’t mean you should stop pursuing your claim. Even if a third party is involved, Safeway could still be responsible for ensuring their premises are safe for customers.

It’s important to speak with a personal injury lawyer who has experience with premises liability cases. They can assess the situation and determine whether Safeway or the janitorial company could be held liable. In some cases, both parties may share responsibility depending on their contracts and duties.

If you haven’t already, gather all evidence you have, including photos, medical records, and any communication with Safeway and the janitorial company. A lawyer can help guide you on the best next steps and potentially file a lawsuit if necessary to make sure your claim is addressed properly.
