Q: My ex is using coercive control and harassing me by reporting false claims to cps and got my kid taken

He doesn’t want to pay TANF his sadistic mother is guiding him he’s made cps believe I’m a drug crazy lunatic yet I was only protecting my son from him. My PO Idea for including my son on it fell through.. because of the pending dependency.. I’ve been researching and haven’t found any real clear answer to solve this (if you can see my previous asked question for background knowledge..) I was thinking I could terminate guardianship of the state and submit my whole dependency petition response but it would be named as supporting docs to the termination filing and show that CPS misinformed me of the initial shelter care hearing court time(I went to the courthouse and paid for all of the docs filed in my case and found the original filing with the real time) so I have proof of that I will include I don’t know if my voice would most likely be heard or not but this isn’t right or fair my son needs me as soon as possible again and away from violent dad!

A: It sounds like you're in a difficult and unfair situation. If you're considering terminating the state's guardianship and submitting a petition, it might help to provide all of the evidence you’ve gathered, including proof of CPS’s misinformation about the court time. This could demonstrate that the process hasn’t been followed properly, which could strengthen your case.

In your filing, you might want to clearly outline the facts and explain how the system failed you and your son, while emphasizing your commitment to his well-being. Including evidence of any discrepancies in the court proceedings and highlighting your concerns about your son's safety with his father may also help support your argument.

It could also be helpful to consult with legal assistance that can help guide you through this process, ensuring that your response is thorough and properly presented. Don’t give up hope; your persistence and your evidence may eventually help bring your son back to you.
