Q: How to I request to get in front of a judge about a child support modification?
I have a child support case out of Illinois. I requested a modification 2 years ago and was never given a court date. Instead, the department of family services stepped in and I sent them all the information they requested for a modification. They did not use the calculator correctly and my ex wife committed fraud and lied on a federal document in which she provided them. This caused the state to increase my support when it should have lowered. How can I request a hearing in front of the judge?
If you are going to be rude and respond without a helpful answer, please don’t. I don’t appreciate being belittled like Ms. Powell chose to do. That is not what this website is supposed to be about. I ask a question to receive helpful guidance.
Just for clarification, a modification was requested. It took over a year to get the documents needed from the state, after multiple attempts to contact them. Once they received our paperwork we received a determination that we did dispute.
A: The dept of family services does not do child support cases. The dept of human services does. They know how to use the calculator. They have access to information that neither of you may have provided to them. You should have been given appeal rights and followed them in a timely manner.
