Philadelphia, PA asked in Consumer Law and Identity Theft for Pennsylvania

Q: Merchant charged my card more than the agreed amount. What can I do to get my money back?

I live in Pennsylvania. We were planning a trip to North Carolina for rockhounding. I contacted a merchant, in North Carolina, by phone to make reservations for two for a mine tour. The lady said they require a $25.00 deposit. I supplied my debit card info for the amount of the deposit. The tour was reserved about a week in advance. We did not make it to the mine tour because of vehicle problems. When we returned home I checked my bank account to find that the $25.00 deposit was never charged. There was a charge from that merchant for $213.50. This amount was never discussed nor approved. This amount would represent the full amount they charge for a mine tour for two people. It was never revealed that they charge the full amount if you are a no show. There is also no such information on their website. In my view they scammed me out of $188.50. I agree that they are due the $25.00 deposit. Is this a Financial Transaction Card Fraud? What can be done to get my money back?
