someone made an illegal left turn in front of me causing me to swerve them and crash. her insurance is denying liability since there’s no proof she caused it since we didn’t come in contact. (she did go into a local allstate unit and it was obvious she was in the wrong even tho they didn’t witness the crash just the aftermath) am i still able to sue? first time crasher here
A: I'm sorry about your accident. A Pennsylvania attorney could advise best, but your question remains open for three weeks. From a textbook standpoint, yes, you have a case. Although the other vehicle did not make contact with you, it appears that they were the cause of your accident. From a practical standpoint, the strength of such a case would depend on a number of factors. These include whether a police report was made, whether traffic citations issued, eyewitness testimony, video footage, and other elements. Every jurisdiction treats comparative negligence by its own rules (a local attorney should advise on that). There's no mention of injuries. I hope there were none. But that would be a factor too. I hope you are okay following the accident. The best way to answer your question would be to reach out to Pennsylvania law firms to discuss. Free initial consults with no obligation are the norm with such cases. Good luck
