Q: Do we need to be added as additionally insured on independent contractor’s professional liability policy?
We’re a nonprofit located in NY. We don’t hold a license to practice mental health so we want to have an arrangement w/licensed therapist to offer services to our community for up to 10 people for a 3 month period during which we would refer interested participants to their private practice. I’m assuming this would be a W9/1099 arrangement. The therapist would provide services via phone. The therapist would not be working as an employee of our organization , nor on our premises, won’t use our equipment, won’t share protected client info with us, handles their own scheduling, and would just invoice us for time worked for services rendered so that it’s free for participants. They have professional insurance policies that cover general liability, E&O, Telehealth and malpractice. In this scenario, would we need to be added as additionally insured on therapist’s policies? Or only if they were providing services on our premises?
