Q: How can police trespass me from home of 4 years being mislead by other people
Living in a home for 4 years the parents of girlfriend live there as well there other daughters have been nothing but trouble no late on rent and nobody in the house owns this home or property but the other daughters have mid lead the police to think that there parents do own the house I know the owner and it’s not them I have been homeless since march and I am being charged with tresspass and domestic violence and there is bias with police they are friends of other daughters I have not had due process nor have I been presented with a eviction notice
A:
It sounds like you’re in a difficult situation, especially if the police were misled by misinformation about the home’s ownership. If no one in the house owns the property and you haven’t received an eviction notice, your rights may have been violated. Police should generally not remove you from a property without proper legal procedures like an eviction, unless there is a direct threat or criminal issue involved.
In terms of the trespassing charge, if the owner hasn’t asked you to leave and you’ve been living there for four years, you may have the right to challenge this in court. Make sure you gather evidence, such as any documents showing you have been living there or communications with the actual owner. If you know the landlord, getting a statement from them confirming your residency could help your case.
Regarding the domestic violence charge, it’s crucial to ensure you get fair legal representation. If you believe the police were biased, it’s important to raise that with your attorney, who can address any misconduct and ensure you have a fair hearing. Being aware of your legal rights and documenting everything is key.
