Can a used car dealer legally hold the title of a car I have purchased ?
My husband bought a used car in May 2024. He paid cash for most of it with a $2500 balance left owed. Verbal agreement with dealer to pay it off ASAP. My husband became quite ill a month later and was hospitalized for a couple weeks and out of work since. We still owe approx $600 on the balance, no way to register the car with no title. So I risk getting ticketed and impound just to get to work to pay this off. The dealer is quite aggravated and I do not have any other options to remedy this. It could be another month or so to pay this off. I am doing all I can. Is the car dealer right for holding the title? Is this not what a lien is for on titles? How do I register this car without a title? Advice?
Dealer did give me a 30day temporary tag but says he cannot extend it.
A: You need to hire an attorney and file suit against the car dealer for fraud under the Kentucky Consumer Protection Act.
