Q: I live in Texas and was in a car accident. Can I negotiate the $2,000 the other insurance co is offering?

I live in Texas and was in a car accident in Sept. I received info from the other insurance company today that I am not at fault. It was road rage by the 25 y/o female. I'm 65 y/o. I pay out of pocket and then submit to PIP for my doctor visits, MR, x-rays, and PT. The insurance will pay for my car repair and medical expenses, including the money I have already spent, even though I am reimbursed through PIP. The other agency is offering $2,000 for my personal use. I do not want to go to court, but can I negotiate the $2,000 with the other agency? The letter states that if I agree with what I just said, I will also agree to discharge all liability from the other party.

A: Compensation for damages arising from an automobile accident is always negotiable. The amount of damages you receive is a combination of medical expenses, physical damage to your body, damages to your vehicle, and pain and suffering. When you are not represented by an attorney, the at-fault party's insurance company will try to force you into a very low settlement. If you are going to represent yourself, be careful in the negotiations as well as in regards to the statements you make to the at-fault party's insurance company, as the will assuredly use it against you if you admit liability in any way.
