Q: How do I begin to file with the tort act claim?

It's a hard case because this is the tribal casinos, although I am a tribal member of another tribe. I file a sexual harassment with the HR then I was punished and transferred to another one my benefits started over and the only available shift was 11pm-7am and a no contact agreement was effective, I terminated my employment permanently bcuz I was punished and the favoritism over my rights. He remained employed with not being held accountable no consequences, a year later I made the hard decision to start gambling although he was there wen I started but then he returned and taunted me I wrote more than five complaints with no results he assaulted me and I finally informed legal action remained wth the taunts until recently after I handed their governor letter however my constitutional civil and tribal rights have been violated not just by him but by other employees now I'm being retaliated against I have all the evidence all the proof and now all those involved r gone including him

A: Starting a tort claim can be complex, especially within a tribal jurisdiction. Begin by gathering all your documentation, including complaints you filed, any correspondence, and evidence of retaliation or harassment. This information will be crucial for your case.

Next, you should reach out to a lawyer who has experience with tribal law and employment issues. They can guide you through the specific procedures and help you understand your rights. If you’re unsure where to find legal assistance, consider contacting a local legal aid organization or the tribal legal services office.

Additionally, keep detailed records of any ongoing retaliation or incidents related to your case. Staying organized and persistent will support your claim. Remember, consulting with a legal professional is important to ensure you take the correct steps and protect your rights effectively.
