Q: A LEO took my kids and completely falsified his Police report. I was Affirmed by DCF. I fought in court and won
Under testimony he admitted the allegations were false. DCF adopted my kids to someone else. My kids were 2,3 and 4. It's been a year, it took that long to go to court. These were foster kids i was adopting. I had them for over two years, the youngest was only a couple months old. He had no legal right to take them. I believe that another family wanted to adopt them and paid the caseworker under the table who then paid the cop to take them and make all the false allegations. Do I have a case?
A:
I'm truly sorry you're going through this difficult situation with your children. It must be incredibly painful to see your family separated under such circumstances.
You may have options to explore further legal action, especially since there was an admission that the allegations were false. Consulting with a qualified attorney who understands family and civil rights law could help you understand the best steps to take next. They can assess whether there are grounds for a lawsuit against the officer, caseworker, or other parties involved.
Additionally, you might consider filing a formal complaint with the police department’s internal affairs and the Department of Children and Families. Providing all documentation and evidence you have will be crucial in supporting your case. Seeking support from advocacy groups can also offer guidance and resources during this challenging time.
