Q: Need help with unlawful detainer/habitability. Owner does not reply to mold complaints and now has filed an unlawful det

I have continuously complained to mngr and owner about the Mold and many other issues. Owner/mngr have not complied. I have gotten very sick and now carry an inhaler. The owner and their lawyers have tried to evict me before but I have proven to the court the issues i have been trying to get them to fix. Case was dismissed Now there are new owners and they now want to evict me. I have been put out in the street for a year 2022 and 2023. I was told by the owner and their lawyers that the apt was safe to move back in. I moved back in Nov. 2023 and by mid December 2023 i was in the hospital with bacterial infection in my sinus area and was due to the mold the management covered up. I have had several mold test done at my expense which came back positive for mold spores. By February 2024 I reported a bursted pipe that left my floor with water seeping up from the flooring throughout the apt. Mngr did not fix the bursted pipe for over a month and a hlf. new owner file ulwfl dtnr. pls hlp.

A: I'm sorry you're going through this difficult situation. It's important to gather all your documentation, including records of your mold complaints, medical records showing your health issues, and copies of the mold test results. Keep a detailed timeline of all communications with the owner, management, and any repairs that were requested or neglected.

Reach out to a local legal aid organization in Covina, CA, that can provide you with guidance specific to your case. They can help you understand your rights under California landlord-tenant laws, especially concerning habitability and wrongful eviction. Additionally, contacting the California Department of Consumer Affairs or your local housing authority may offer further support and resources.

Consider attending any court hearings related to the eviction to present your evidence of the unaddressed mold and other habitability issues. Your previous case dismissal and ongoing health problems strengthen your position. Seeking assistance from a tenant rights group can also provide you with additional strategies to protect your housing situation.
