Los Angeles, CA asked in Contracts, Personal Injury and Products Liability for Texas

Q: If my trainer failed to adequately advise me nutritionally could he be in breach of our contract?

He agreed to provide advice on nutrition plans in the contract we signed. After discussing my restrictions (Gastric sleeve, Liver transplant) this trainer promised he knew "shortcuts" to get me the nutrition needed to build muscle. He custom designed this shake for me to drink twice a day, and pudding to eat once a day. After the first two days, I noticed discomfort while drinking the shake, but he told me "I'd get used to it." It worsened to the point of debilitating cramps, and pain. He still would not alter the diet even when I offered alternatives. I discovered on my own that he was allowing me to ingest 261.4g of powdered protein a day, which put a terrible strain on both my liver and kidneys. Still, he did not provide an alternative. This pain caused me to not be able to even work out or walk around. Is he in breach of contract for failing to live up to the nutrition advice part of the contract? Thank you for your response. I have more info if needed.
