A: Yes if all parties agree. This happens alot without first filing a suit.

A: Your post doesn't indicate the nature of the matter, whether it involves court proceedings by operation of law. I could speak for matters involving insurance and casualty types of claims (personal injury, med mal), the answer is generally "yes." Good luck
