Q: Can an employer cancel out my earned PTO that I earned in CA if I move to TX? Ive been employed 27 years same company.
I have worked for the same company for 27 years based in CA. I also lived in CA. 25 years in I moved from CA to TX for a better cost of living and still work full time remotely, Shortly after moving we were acquired by a firm based in Utah. At the point of Acquistion I had 200 hours of PTO on the books worth roughly $18,000.
Then, the new company informed us that they were switching from a traditional earned PTO system to Flex PTO in 2 weeks. They informed staff that they were going to be wiping out any accrued balances and that CA based employees would receive their hours upon departure from the company,
Texas law does not have that provision so essentially they wiped out my appx $18,000 out and would not be paying it upon departure,
I'm still employed there but I feel the $18,000 I earned in CA prior to acquisition should still be mine.
Did I lose that by moving to Texas?
